Legal Question in Family Law in California

I want to remarry, but current spouse is missing...

My husband has been missing for over 5 years! I have no idea where he is, but would like to remarry within the next year. Do I have to pay for a divorce from a man I haven't seen in all this time or can I legally remarry my fiancee later on this year? If I do have to get a divorce, will I have to wait the six month period required in California???

Yes...you have to get divorce and you have to wait 6 months.
