Legal Question in Family Law in California

Do I have the right to remarry if I was married in the Philippines, I had been a resident of CA for almost 16 years. And can I file a divorce?

You have the right to remarry if, and only if you have been divorced. If you have not been divorced, then you may not remarry. You may have a jurisdictional problem with filing a divorce in CA if the husband is still living in the Philippines. I would suggest you contact a local family law attorney to help you with that issue.

You can't remarry again in the United States unless your first marriage is terminated by a decree of divorce.
