Legal Question in Family Law in California

How to remove dangerous spouse

Hi - My two girls and I are currently hosting their dad while he ''gets back on his feet'' and I'm wondering what is the best way to have him removed from the home. I filed for divorce two years ago, but due to an omitted form I was not granted a judgment. He has since moved back in and is ''trying to get back on his feet'' but is not making very much progress. In the meantime he is living a carefree bachelor lifestyle, ignoring the girls, bringing shady looking friends around the house. He is a recovering alcoholic/drug abuser, and I'm afraid he may be abusing again. He keeps very odd hours, and lately does not come home for days at a time. His physical condition is deteriorating, he has lost weight, and is very unhealthy looking. I have repeatedly asked him to leave, but he does not have a steady job and shows no signs of finding one. I would like to file for divorce again, but don't have funds for an attorney. I'll be doing it soon, but in the meantime I need to find out how to have him removed from the house, if possible. Any advice would be very much appreciated. Thank you.

Re: How to remove dangerous spouse

Check with the police for a local abuse help center. You should be able to get a restraining order removing him from the house.
