Legal Question in Family Law in California

Removing Name on Car Loan after divorce

My ex-husband is three months behind on his car payment. Our divorce papers state that he is solely responsible for this car payment and the finance company is unable to locate my ex so they are threatening to garnish my wages. How do I have my name removed from this loan? My Ex can't refinance and get approved.

Re: Removing Name on Car Loan after divorce

You can have your name removed from the loan only by his refinancing, which he cannot,or the consent of the lender, which they will not agree to as his is delinquent. File a motion with the court requesting permission to sell the vehicle for the highest amount possible to reduce the monetary loss.
