Legal Question in Family Law in California

Can I request to have a new 730 evalution?

I just finished a 730 evalution in San Bernardino County. I feel that the evaluator was not objective in his findings and has discriminated against me and my new husband. There are many contradictions in his report and I have found some information online regarding this evaluator being pro father. Also the evaluator was not given all of the information from the beginning of my divorce. This evaluation was court ordered, but because my ex was unable to afford his half I paid for it all. I wanted to know if I can request a new 730 evaulation? If I am able to get a new evalution can I pick the evaluator and how do I make sure that the new evaluator has all the information he/she needs to make an objective report?

Re: Can I request to have a new 730 evalution?

You can have an evaluation done by a shrink (MFCC or Psychologist) that you hire. But it is not a 730 evaluatuion unless the court orders it, and you would be unlikely to get another 730 from the court. Maybe the expert you hire will draw different conclusions, and you would certainly be free to call your hired expert as a witness at your own (substantial) expense. An experienced family lawyer who regularly works the courthouse would know which local shrinks are good for this purpose / are respected by the local judges.
