Legal Question in Family Law in California
I reside in L.A. California, want to separate from my partner of 16 years (we are not married) we own a home together with two children a 14 yr old and a 12 yr old. He is self employed and will state he can not afford child support. With this being said, if this is the case he can not afford the mortgage either- I would like to know if I can stay in the home with our children and pay the mortgage

Because you were in a non-marital partnership, your case on dividing the residence would be a civil litigation action to quiet title.
Child-support and parenting would be through the family courts. It would be to your benefit to have a forensic accountant review the finances of your partners business to ascertain appropriate child support levels.
Your situation is complicated and justifies the assistance of an experienced civil and family law attorney .
