Legal Question in Family Law in California
Hello. Please let me know how to respond to a child support modification request by my ex husband? We have a court hearing set for next month in the Los Angeles Superior Court in Downtown.
1 Answer from Attorneys
As always, and especially with something so critically important as your child's support, you should seek the help of a competent attorney. At minimum, help from the local family law facilitator at the court can at least get you the following forms.
You must fill out a responsive declaration (Form FL-320), and an (updated?) income and expense declaration (Form FL-155 or 150) and take the original and 2 copies of each to the clerk's window at the court in question, and file with the court. The clerk will keep the original and stamp the other two copies showing that they were filed.
Once filed, you then need to have a friend serve one copy of each document on on your child's parent by mail, keeping the other copy for yourself (form POS 020 or FL 335 will do). Have your friend fill out the proof of service showing that you served these and file that again with the court, the original and one copy. Keep the stamped copy for your records and take the entirety to court.
You must respond timely to the papers sent by your child's other parent. You can get these forms online or you can go to your local court and ask for the family law facilitator. They can get you copies of the forms.
