Legal Question in Family Law in California

responder address unknown

California: I have been separated from my abusive husband since '97 or '98. I wish to divorce him, but do not know his whereabouts. He has threatened my life so I do not want him finding me. Where do I need to publish an intent to divorce, in a paper of the county of our marriage, or where I live now? Does it have to be worded a certain way? How long do I wait after publishing to file for a divorce?

Re: responder address unknown

If you can locate him then you will have to serve him. However, you can keep your address confidential, either by retaining an attorney or requesting a court order that your address is to be kept confidential. You should also obtain a dv restraining order against him. Also it has been my experience that where a spouse has been abused, retaining an attorney to represent that spouse in court is a great advantage.
