Legal Question in Family Law in California

Once Response is Filed

When Petitioner sues for divorce the Respondent responds. Once the Response is filed with the courts what happens next? Can you enter in the Entry of Judgment and Judgment papers so the Judge can issue his Judgment? There was no property or anything to split, divorce is fairly simple and uncomplicated. Straight divorce.

Re: Once Response is Filed

If you and your spouse agree on everything, then submit a proposed

Judgment of Dissolution of Marriage (on a required form) with your signed

agreement; you will also need a Notice of Entry of Judgment, and an Appearance, Stipulation and Waivers form.

No judgment will be entered unless you take some action. If there is no agreement,

but nothing for the court to do but terminate your status as married, then set the matter for trial,

unless your spouse can agree to sign the forms (as noted above) for a status-only Judgment.

If there were any children born to the marriage, or a big difference in income and

a marriage that lasted for some time, then the matter may not be as simple as you

think.
