Legal Question in Family Law in California

Response filing time frame

My ex-husband served me with paper to have our child support re-evaluated and possibly reduced. I was told by a friend that a reponse was needed to be filed with the court system. What is the time frame that the response must be filed with the court? Does it have to be filed a certain number of days before the hearing? Once filed I think I have to serve my x-husband with my response. What is the time frame for that and do I need to have someone serve him or can I mail it back to him. And if it can be mailed do I need to have a proof of service by mail form included and signed. How many days before court does he need to receive them?

Reply: Response filing time frame

In a general sense, the Response and related documents should be filed 9 court days before the hearing, with a copy sent to the moving party by mail. You will also need a proof of service for the responsive pleadings.

For a specific opinion regarding your individual circumstances, I suggest that you consult with an experienced family law lawyer. Experience is not expensive, it's priceless!
