Legal Question in Family Law in California
Responsibility of a guardian/caregiver
I was recently involved in an ugly custody case with my daughter and her ex-husband over my 12 year old grandson. The court awarded equal custody to both the father and mother, however, when my grandson is not with my daughter he lives his non-biological grandfather (his dad's step father) because his dad does not have a suitably place for him to live. Recently, the dad took my grandson out of school for one week for a motorcycle race against his mother's wishes. Is the non-biological grandfather a guardian or caregiver? He was aware of this abduction and did nothing about it. Isn't it his responsibility to make sure the child is not only fed and clothed but in school. The court document that spells out the arrangement recognized that my grandson is living with this man but does not outline his responsibilities or title. Please help.

Re: Responsibility of a guardian/caregiver
Your situation is complex and there is more than one possible course of action. A motion to change custody could be filed. You could also asked to be joined to the action. You need to discuss this with an attorney to pick the best course of action.
