Legal Question in Family Law in California

restraining order

Can C.P.S and the father of my girlfriend son make my girlfriend get a restraining order on me as a condition for her to visit her son. The father does not like me and doing everything he can to to keep us apart like reporting her to C.P.S. for drug use and child endangerment. drugs are her prescription. and the endangerment is that the kid was around the drugs, and her being on them. the case is total BS. and he did it to get custody of there son, to hurt her for being with me and not him.

Re: restraining order

Your girlfriend can get a restraining order if she is the victim of domestic violence, it is always up to the petitioner to decide whether or not they feel like they need a restraining order for their protection.

As always please consult with a local attorney prior to taking legal action. Good luck.
