restraining order

my husband and i go into a physical fight, i was charged, and now i cannot go near my home within 100 yards isit possible to overturn my charges since he will not modify the restraing order? Please help, he also will not file for divorce, since he know he might have to leave the home, Al lso we have a 9yr old daughter, she spends most time with me. i have no money to pay an attorney. am i able to file a civil suit to see if that helps me ge t back into our home?

File a petition for dissolution, and file an Order to Show Cause asking the court to order him to move out and let you live there, or to at least get child and/or spousal support so that if you can't get back into your home, it would help you to get into a new place.
