restraining order

My ex and I nhave mediation next week. We agree the kids stay with her. She has restraining order on her shes bitter towards me and my girlfriend. She afraid she will lose the kids, kids are good with her will she lose the kids or does the restraining order only pertain to her leaving me and my girlfriend alone,kids are happer with her and shes a good mom just a bad ex wife

Re: restraining order

A domestic violence restraining order makes it very difficult for the restrained party to get custody. However, if you as the protected party recommends that she have custody, the restraining order will have a lessened affect on her chance for custody. The best way to resolve this matter is for you and your ex to sit down and work out a custody and visitation agreement. This could then be presented the court for signature by the judge. This would make it a court order.
