Legal Question in Family Law in California

More than one Restraining order

During the past 2 years my son's wife filed for separation in California while temporarily located there and got a Restraining order on him. Then she moved back to Washington State and filed for divorce that included a ''continuing'' restraining order. Each restraining order has different orders, such as distance, phone calls, writing and so on. Are both of these restraining orders affective or does one overide the other? He is concerned as he would like to simply write his daughter.

You have hit on a very complex issue that is really fact dependant. The simple answer is that there can be more than one restraining order over a person, and when there is a conflict, that person needs to appear in court to resolver the differences,, the simple answer is follow the most conservative order, so not to be in violation of either....Your son should really consult with someone to go over the specific orders to check to see if each is valid...good luck..pdm
