Legal Question in Family Law in California
I am going through a restraining order because my ex wife and i are going through divorce with our son involved. I have a long cause hearing and I do not have any idea what I need to do prior to going to court. Any advice would be great. I am 22 years old.
1 Answer from Attorneys
A long cause hearing is basically a hearing that is longer than the 20 min that is allocated on the law and motion calendar. The hearing will either be the morning or a full day evidentiary hearing. It is basically a mini trial, which if you are self represented you will have to prepare for as if you are a lawyer. If they have an attorney then you can bet that you will be held to the same standards as an attorney. It might be a good idea to discuss with a few attorneys or low cost ones to see if you may be able to afford representation. If that is not feasible then you should consult with the family law facilitator in your county to see if you can get some advice on how to represent yourself.
For self represented individuals you can consult with the family law facilitator self help center at your local court house.
As always please consult a local attorney prior to taking legal action. Good luck. Also please check out my Santa Clara County Family Lawyer blog.
