Legal Question in Family Law in California

Restraining Order?

My wife has other men coming over to my house while I am deployed over seas. Is there anything I can do to stop this? I don't like strange men hanging out in my childrens home until the early hours of the morning. I believe it is damaging for my children to see their mother behaving that way. Are there any legal means I can use to prevent them from coming in my house?

Re: Restraining Order?

I am not aware of any legal provisions for the relief that you are requesting. Such a law would probably not be constitutional as it would interfere with her right to association. Furthe who would enforce such an order if it was obtained. You might be able to get the children removed from her custody and placed in your parents home or some other such home if you can show that her conduct is placing the children in danger.
