Legal Question in Family Law in California
Restraining Order
My wife and I are getting separated and she is taking my daughter to a different state. She's been talking to some guy online that's been sending lewd pictures and he said he wants to meet up with my wife when she moves. He also lives in a totally different state. Do I have any legal standing to request a restraining order against this guy for my daughter? I don't want someone my wife met online and who sends those types of pictures around my kid. My wife says I can't get a restraining order because he hasn't did anything illegal to her. I don't want to take the chance of that happening. I'm in the military and I can't keep my daughter here with me. I just want to make sure this guy stays away from my child. What are my options?

Re: Restraining Order
Go to court for an order that your wife can't leave CA with your daughter. At the very least get a restraining order that she can't take your daughter around this guy.
Re: Restraining Order
You should get a restraning order to prevent your wife from taking the child out of State. That restraining order is automatic when you file for a dissolution of the marriage. File the dissolution now! Set a hearing for child sharing and explain the problem and get verification of the internet problem to show the mediator. You might be able to do this yourself but if it is important to you, you should give it your best shot and that is with an attorney. You may contact me for a free consultation. Good Luck, Pat McCrary
