Legal Question in Family Law in California

restraining orders/divorce

part 1: my husband left aug31 and has not contacted me since. even upon request by his friends to do so. I have two children. one is ours and the other is mine. they know him as ''DAD''. with his leaving our lives and my children now adjusted to him gone ie they can be in preschool now when before they were not allowed previously. (just some insight). how can i keep him from taking my kids other places without my knowledge and or until i can get my divorce paperwork through?

part 2: before he left he said after he did what needed to get done he wanted our now 2 year old to stay with him and until he had a place to live that she would be staying in a different state than either one of us is there any way that i can prevent this verbal agreement from going through if the divorce is not finalized? how do i keep custody of my kids and get his revoked?

You need to consult with an attorney. Contact me directly. Don't try this alone.

You don't have to wait for the divorce to go through. File an Order to Show Cause for custody and visitation. You should do it "ex parte", which means on one day's notice, and get temporary orders giving you custody until the matter can be set for a full hearing.

You have some complex issues that really need the assistance of an attorney to give you any answers or advice that would have any value. Get a consultation with a child custody attorney who can give you that valuable advice. Good Luck, Pat McCrary
