Legal Question in Family Law in California

restraining/protective orders

can my ex file a restraining order against my son to not come to my house and see his sister? My son has never been violent or harassing towards anyone in my household. Just recently he got into a fight at a party and a friend brought him to my home because he was drunk and upset. His dad does not get along with him and because I don't agree with his aggressive approach when discussing ''family'' issues, he has threatened me with a restraining order in my home. How is that even enforceable? My current husband agrees that there is no threat.

Re: restraining/protective orders

He would have to file a motion or OSC requesting that the court terminate contact with you. Whether he would be successful in another question. Your best approach would appear to be to prepare by consulting with an attorney regarding this matter. You will then be prepared if he does attempt to take any action.
