Legal Question in Family Law in California

restriction order

Hello, can I go back to see the judge and have a sentence changed. The judge put a restriction order on me for being violent on the phone with my ex-partner,the mother of our 8 year old son . I cannot see my son for 3 years because I was insulting his mom over the phone. At the time I was a drunk. I also showed up drunk at her door step. Nobody was there but I got arrested and then I got this restriction order because of these terrible phone calls. Since then I went to rehab (1 week after this incident)and I am totally clean since 4 months. I went 3 months into rehab-I am now in sober house. My ex-girl friend is ok with me trying to get visitation rights. Can she help with that? Can she ask the judge to change his sentence. or is it to me to ask for another judgement.warm regards

Re: restriction order

That must be changed as your parental rights may be terminated, if they already have not. Contact me directly.

Re: restriction order

You can request a modification of the existing order. You will be required to show that the conditions have changed since the last hearing which it sounds like you will be able to do.

If you are serious about getting legal help for this, contact my office.

Best of Luck.

Re: restriction order

Yes you can modify the current order. I would say that the chances of getting modification are very good. You should have an attorney who can advise you and let you know what hoops to jump through in order to get the best possible visitation order. Good Luck, Pat McCrary
