retaining family rental home
I live in san francisco, a very high rent area. I want to start divorce proceedings but am worried that an attorney will advise me to move out. i have two dependant children and cannot afford to move from our rent controlled unit. i have asked my husband to move out on many occasions, but he refuses. he is violent toward myself and my teenage daughter, i have so far not called the police to avoid any further stress to the kids. if i file for divorce, will i ber able to keep the current apartment.

You should have called the police they would have arrested him and given you a temporary restraining order. then you could have obtained a restraining order for three years. This would protect your children from possible injury or worse.
You can file for a restraining order based on the past abuse, even if the police will not file criminal charges.
Either way he will be removed from the family home.
