Legal Question in Family Law in California
retirement
I am divorced, and want to know if I am still entitled to my x-husbands retirement pay. We were married 6 years, we have been divorced for 20 years and he has been retired for at least 9 years. He was not active in the reserves now.

Re: retirement
yes, typically at the time of marital dissolution, a QDRO (qualified domestic relations ordered) is filed accordingly to ensure the non-owner spouse's community property interest (yours) is fully protected and vests in your benefit. if you would like assistance in this matter, contact us today.

Does your marital settlement agreement address it? Call me directly at 16192223504.
Re: retirement
If your dissolution judgment is from California, did not address the military pension or retained jurisdiction over the pension, the answer is probably yes. You will need to have an attorney bring a motion and you may be entitled to back pay on the payments. Good Luck, Pat McCrary
