Legal Question in Family Law in California

retirement and spousal support

I have been trying to come to an agreement for spousal support with my husband. He is now refusing to pay me because he does not want me to have access to his retirement. He also states that I owe him for a credit card that is under his name. And now he is not willing to let me claim half of the interest paid on our house for taxes. What do I do?

Reply: retirement and spousal support

In a general sense, community interests in retirement plans are divided equally among divorcing parties as well as community debts (irrespective of whose name the debts are in).

For a specific opinion regarding your individual circumstances, I suggest that you consult with an experienced family law lawyer. Experience is not expensive, it's priceless!
