Legal Question in Family Law in California

Retroactive child support & medical coverage

I was divorced 15 years ago and have been paying my ordered support the entire time. My ex never sought medical coverage for my daughter and it wasn't required in my divorce decree.

my ex is now threatening to take me to court to recover additional monthly support retroactively for the past 15 yeas. She is also claiming that I will have to pay 15 years of past medical expenses (braces for my daughter).

i know she can file a motion to increase my monthly support, but can she collect the increase retroactively for the past 15 years, along with medical expenses that she never informed me of or asked for assistance with?

I haven't even been allowed to see or speak to my daughter since 1993 (in violatio of our custody arrangements). She has 100% custody.

Re: Retroactive child support & medical coverage

Support orders cannot be modified retroactively. As to the medical bills there is authority for the court to make that order, but it probably would not apply with your fact situation. More information is needed to give a better opinion. Good Luck, Pat McCrary
