Return of Personel Property

Four month ago,I got legal custody of my grandson. My grandson has asked his step father to please, return his personel property. Things that I, over the years, got for him. Books, clothing videos and toys. When my ex son-in-law handed over my grandson, all he came with were the clothes on his back, nothing more.

I have asked him to return the savings bonds my family purchased for him, his social security card, health records and so on, but he ignores these requests. Do we, my grandson and I, have any legal rights to this property. What do we do, his step father told my grandson he has to itemize all his property. I have been buying these things since before my grandson was born nine years ago, how can we be expected to remember?

You can sue him in family court or small claims court to recover the items if you can list them all, plus their value.

As a practical matter, is it worth it? What are the chances you'll actually get the items returned in good condition? As disappointing as it might be, it is probably in your (and your grandson's) best interests to leave this unfortunate situation behind you without further stress, fighting in court, and heartburn, and work on creating new family traditions, possessions, and life without any unnecessary contact with a father who isn't able to have custody of his own child. It's your adult guidance that will help this poor child move on. Think of the psychology of the situation before you think of the actual items involved--my guess is you'll decide that the "price" of attempting to get the items returned isn't worth it.
