Legal Question in Family Law in California

name reversal

I have been divorced for 3 years and would now like to bo back to my maiden name. If this is not listed in my divorce decree is it legal? how do I start?

There is a one page form , EX-PARTE APPLICATION FOR RESTROATION OF FORMER NAME AFTER ENTRY OF JUDGMENT AND ORDER, from the clerk of the court that you can complete, the judge will sign and your former name will be restored. Good Luck, Pat McCrary

Go to Accesslaw on the internet. Select judicial council forms; scroll down to the bottom of that section to forms by category. Select the family law section. Then scroll down to form FL 395*. This form is an exparte application to restore former name. The court may charge filing fee for this form. In Santa Clara County the total filing fee would be about 52.50. If this is more than you can afford get the forms for the a fee waiver. Many counties have a family law clinic that gives free legal advice. This form should give you the result that you want.
