Legal Question in Family Law in California

Rights to digital images

The mother of my child and I seperated (never married) after 3 years of living with each other. She wants copies of the disks (negatives) of all the digital pictures that were taken, 99% taken by me, over the first 14 months of my daughter's life. If I owned the camera before we met and the disks are my property, does she have any rights to hard copies of the disks? I think that copies of individual pictures (paper) would be fine, but I should be compensated for my time and the cost of producing the pictures. Can I be compelled by a court to give her hard copies of my work that would allow her to reproduce my work at her leisure? Additonal reproduction of my work is my major concern, would she have the right to hard copies of digital information?

Re: Rights to digital images

A mother has the right to pictures of her child that were taken in the course of family life. If you are a professional photographer, then you could ask that she be prohibitted from using them professionally.
