Legal Question in Family Law in California
My rights in divorce
My husband is a recovering drug/alachol addict. He has been sobre for 15 months.During his drug use he proceeded to run up ALL of my credit cards. He would take balance tranfer checks out of the mail and write checks to himself. I asked the credit card companies to stop sending checks , as I was dealing with a drug addict that was stealing from me. He managed to gamble all of our equity away in our home. He basically went through All of our money. When he went into treatment ,He had'nt even paid the electic bill. Since he has been sober , he has really not held a real job. I am a flight attendant, and am flying the equivilant of two flight attendants hours. I am doing this because we have 2 teenagers. I have also taken out 2 401k loans to get us out of forcloser. At this point, I just want to get him out of my house. I am the only one on title, and I filed for divorce in 2005. My question to you is 1] What should I do about making him accountable for the theft on my credit cards? Can I even do that? He also owes the Irs130,000 dollars in back taxes. We are currently in a offer compromise for that. What are my rights , and how do I get the divorce going again. I feel helpless in this . I really need some good advise. Thank You

Re: My rights in divorce
You should retain an attorney to represent you in the divorce. You may be able to avoid liability for some of the debt incurred by your husband.
