Legal Question in Family Law in California

My rights in a divorce

After 29 years of marriage, my husband walked out and filed divorce, the reason was he didn't love me anymore. The divorce is not final until February 2003, however; he has taken 3 trips to visit another woman, quit his job and took a new one with the first week being vacation so he could go visit the woman again. He agreed to help me with our bills, and now I have rent due and several other bills.

What are my rights? How would I proceed to get them.

Re: My rights in a divorce

You may be entitled to alimony (now called "spousal support"). Whether you are entitled to alimony depends on your husband's income, your income, and your work history during the marriage. To get it would require filing a motion with the court. Feel free to call me at 818-240-0484 to discuss the possibilities.

In addition to possible spousal support, you are entitled to half of your and your husband's "community property." The actual division may not be exactly half, depending on your financial situation and the amount of debt you have. The first thing you should do to protect your rights is file a RESPONSE to your husband's Petition.

Re: My rights in a divorce

You did not mention if you have filed a response to the petition for divorce and if you are employed.

You can file an Order to Show Cause for temporary spousal support.

I would be happy to discuss this approach with you further. Good Luck.
