what rights can a father demand when he never sign the declaration of paternity or he isnt on the birth certificate of my 8 year old son?

Assuming you weren't married at the time your child was conceived and there has never been an action declaring him the father (by the Court or the Dept of Child Support Services), he doesn't have any rights absent a court order. He needs to file a paternity action and request a DNA test (if you're contesting paternity). He can then seek a custody/visitation order and you can seek a support order.
