Legal Question in Family Law in California

rights of incarcerated parent

Can my ex move and take my kids with her out of state while I am incarcerated? My boys do not want to move. Their ages are 14, 13, & 9. Do they have a right to state who they want to live with?

Re: rights of incarcerated parent

She has the right to move and the court will not tell her the children cannot go with he when you are incarcerated. Because you have no visitation with them then the move cannot adversely affect your visitation with the children.
