Legal Question in Family Law in California
my rights as respondent
My husband and I are filing for divorce and have already decided the division
of assets/property and put it in writing. We have no children. Because it is
cheaper to file as petitioner/respondent than to file mutually, my husband is
filing as the petitioner and I am the respondent. As the respondent, am I in a
legally weak position at all? Am I putting my rights in jeopardy in any way?
Would I protect myself better to spend the couple hundred dollars and file
mutually?

Re: my rights as respondent
There is always a petitioner/repondent, even in an uncontested divorce. But the answer is no, your position as petitioner or respondent in an uncontested divorce in CA is irrelevant. But you should have a professional draw it up and file it.
