Legal Question in Family Law in California

what rights do sibblings have

My husband is a cross country truck driver. Hes gone 8-10 days at a time. At this time he has visitation of everyother weekend and during the summer everyother week. Recently his ex and his son has moved back into our area. We would like to continue the everyother week visitation, due to the fact we are close enough to drive his son to school. His ex is fighting him on this due to him not being here all the time although he has 2 half brothers that are here. If we go to court and ask for more visitation what rights do these sibblings have to be together even if there father is not home everyday. Could we use the sibbling rights if she fights because the father is not here??

Re: what rights do sibblings have

There are really no rights that sibblings have, there is only the best interest of the child. It may be in the best interest of the child that he have a stable relationship with his siblings. That and many other factors will be considered by the court. Good Luck, Pat McCrary
