what are my rights?

my wife wants to leave the state and move back east at the end of the kids school year, and move in with her mother. we have been having relation ship problems for years and refuses to go to counciling. I want to stay here. what can i do to protect my rights.what are my options.I would like to take an amicable approch to this.

If your wife intends to move out of state with the children and you want the children to stay, then you need to file papers with the court in order to prevent the move.

You should both then discuss the matter to determine if you can reach an amicable solution. If such solution is not forthcoming, then you will need to be prepared for a court battle in a "move-away" request.

I strongly suggest you retain the services of an attorney to assist you.

You can file a motion on child custody which will include an automatic order restraining either from removing the children from the State of California.
