Rules regard mediation
Does the family court permit one of the parties either the petitioner or respondent, summoned to a custody mediation to participate by way of telephone because one lives out of town now? If so does the other party have to be in agreement and notified by the court in advance?

Almost all courts allow telephonic participation for mediation sessions. Each court will have its own procedures and therefore you should check with the local court. An attorney may not participate in the mediation for you, but may represent you at a noticed hearing. Good Luck, Pat McCrary

some courts will allow it. you can also have an attorney appear for you and submit written declarations.
