My brother ran away from home and is now with me. The police have been notified and he does not want to go home. The living situation with my mother is really bad, yet she is insisting he come home. Can she legally come and get him?

There is no simple answer to your question. How old is you brother? What are the problems when he is living with mother. If the problems at home are bad enough to justify his not going home then CPS could become involved. The other option would be to file a petition to be named his guardian. Unless mother agrees a trial will be required and the information about the home will be brought at the trial.
