Legal Question in Family Law in California
School costs
My son's father has been paying half of his preschool costs. Last week he decided he did not want to pay anymore. I thought the father was required to pay half, even though it's not stated in our court order. Please help.
Thanks

Re: School costs
if you have a track record of your ex voluntarily making such payments even in absence of a court order here, your chances are very good in getting this stipulated as part of the actual court order. however, under the circumstances, an OSC hearing will most likely be needed to "incorporate" this into the court order in a timely manny and preserve your legal rights. if you would like such prompt legal assistance, contact our office today.
Re: School costs
If payment of preschoolfees is not in the court order then you may or may not be entitled to have preschool payments. Look to the court order. Were there orders for daycare and if so, how much? Did the court intend that the child support awarded reflect the father's contribution to the preschool payments? These are relevent questions which must be considered. The court will also need to consider all other relevent information, including without limitation, your income, the father's income, Daycare expenses and the amount of support currently being paid.
You really ought to seek advice from counsel to determine if it is worth your while to pursue this matter by way of Order To Show Cause.

Generally speaking, the underlying Court Orders specify what is required.
