Legal Question in Family Law in California

Seeking Divorce

I'm filing for a divorce after 19yrs of separation. I own a home that I purchased 4 yrs ago. I would like to also petition for back child support, medical/dental which he never paid. How can I go about in doing so? Also he's incarcerated until end of February, can the facility serve him? Can the DA's office serve him? Or does it have to be through publication?

Re: Seeking Divorce

He can be personally served at the prison. Contact the prison and determine whether they will do it. If the prison will not serve him, then contact a professional process server in that area and arrange for him to be served. As to child support you are as a general rule prohibited from collecting for the support of your child unless there is a court order.
