Legal Question in Family Law in California

Ex is self-employed

My ex was unemployed when our divorce was final. Since then our situations have changed and he has been paying my bills and giving me a few hundred dollars/ month. But now he wants to stop paying me anything. The biggest problem is he's self-employed. He can and DOES hide money. How can I take him back to court and get everything re-done, but make sure he discloses all income?

Are there any minor children?

Are there any current orders for child &/or spousal support?

Did the court retain jurisdiction over spousal support?

The court will look at his budget, how much money is he spending and consider your testimony. Many times we can supena applications for car loans or housing to get the amount they claim to others that they earn. Finally, the most effective way is generally to ask the court to appoint a special master to determine his income. In San Diego County we have a few accountant/attorneys who perform that function and who the courts trust in making the determination. Good Luck, Pat McCrary
