Legal Question in Family Law in California

I Want to sell the house!!

My husband and I have been all but legally divorsed for the past 3 years. He doesnt even live with us(the kids and I)anymore,he works in another state and visits for 2 or 3 days every 5 or 6 weeks--He has no plans of changing his location of employment nor his lifestyle. I want to sell our home (he keeps putting it in forclosure every 3 or 4 months)but he refuses-The kids and I hate living in the home because of the neighborhood and the bad memories the house holds(there was alot of physical and verbal and mental abuse at the hands of my husband towards me) and the kids and I are embarressed and humiliated. We want to start fresh somewhere new.Ive filed for divorse but havnt got him served because I never know when he will be around and when he is hes never in one place for very long.I have no phone number, address or co. name for where he works or lives.I need a good lawyer who can work for me now and get paid after the settlement--which should be pretty substantial because for the equity in our home(about 100.000) back alimony support and back tax returns, vacation checks and sick leave checks along with a long list of property damage and stolen items.

Re: I Want to sell the house!!

You can file a motion requesting that the court order the house sold. The court can order him to sell the house, and if he refuses to cooperate the court can order the house sold without his signature.
