separation and inheritance

I am separated, not a legal separation. If I recieve an inheritance from my father, is my spouse going to get half of it?

Reply: separation and inheritance

Inheritance starts off as your separate property, whether or not you are living together as husband and wife. Do not co-mingle the inheritance with community property funds (including earnings while living together as husabnd and wife) to maintain the integrity of your separate property.

Good luck to you!

Re: separation and inheritance

typically, when you are living apart with no intent to reconcile, a legal separation is not needed in respect to community property issues.

further, an inheritance is deemed your separate property in most circumstances as well. if you email the specific facts of your inheritance and separation i can further assist you and help ensure your rights to this inheritance are protected.
