Legal Question in Family Law in California

Separation

I am in an unliveable situation at home; we live with my in-laws and my husband and mother-in-law verbally and emotionally abuse me and our children. I don't want to get a divorce, but I do feel like a separation would help my husband get his head on straight. We have two children and I intend to move out with them. How can I protect my rights as a parent? Could moving out be construed as kidnapping? I have no income. Can I compel my husband to support me? I have friends/family in another state. Is it advisable to remain in CA?

Re: Separation

You could move into a shelter or a friends home. Notify the police and district attorney where you are. Then file for a legal separation and request support for yourself and the children. Unless you can get him to cut the apron strings and live his own life with you and the children you will never get what you are looking for.
