Seperate or community property

I owned my duplex prior to the marriage. It has remained in my name only during our 8 year marriage. I have been employed the entire length of the marriage. Is he entitled to any portion of my duplex, or can he be awarded any proceeds if I sell?

I disagree with Mr. Koury. The duplex remains your separate property and there may be some reimbursement that he can claim. If he raises the question, see a good family law attorney who can obtain all of the necessary information from you to give you an opinion of whether there is any community property reimbursement. There is probably not enough of a claim to hire two attorneys to litigate the issue. Good Luck, Pat McCrary

only to the extent community property was used to make morgage payments.
