Legal Question in Family Law in California
Seperate property maintained with community assets,
My wife inherited $10,000.00 while we were married. We purchased a Van 4 years ago with the money. We used a vehicle my mother gave me as a trade in. The Dealer gave us $1,600.00 on the trade in towards the purchase of the Van. We paid an additional $9,500.00 for the Van. In the past four years we have spent $10,000.00 of community assets for Registration, Insurance, Maintenance and Major repairs. I am now being told that the van is her seperate property. If I had known I had no vested interest in the van I would ot have agreed to the Major Repairs or paying full coverage insurance, since the Van was paid for, full coverage was not necessary. Do I have any Legal right for reimbursment?

Re: Seperate property maintained with community assets,
You would have 1600/10000 interest in the vehicle. That interest hardly seems worth attempting to collect.
As far as the insurance repairs etc, you received the use of the vehicle during that 4 year period. You would probably not have a right to reiembursement for taxes and insurance. The major repair may be different, if it increased the value of the van. But is does not appear that you are talking about much money.
