Legal Question in Family Law in California
Seperated or What?
I have been married for 15 years and 2 years ago came into quite a bit of money from a family death. I have been told that my husband can get half of what ever money i spend on the house or myself as it transfers it from seperate to community property. Does this hold true for buying businesses as well?
Also, we have stopped sleeping together in the same bed and are now roommates more than anything else. I feel that I am ''seperated'' altho its not thru the courts, husband says we are still married. (i hosted a party a month ago and introduced my spouse as my husband to save myself embarrassment in front of high school friends (its my 3rd marriage)
Am i sepearated? does hubby have a legal claim to my businesses?
please help

The business would be community property. You may be able to claim a right to contribution for the separate funds you deposited into the business. In order to give you a clearer answer I would need to consult with you.

As has been stated this is a complex area of the law. Before buying or disbursing any more of the this money you should consult with an attorney. The method used in purchasing a business etc can result in converting your separate property into community property.
