Legal Question in Family Law in California

i have seperated from my sons mother about 2 years ago we have never gone to court for the childs custodial rights everything has been pretty much a verbal agreemant recently she has taken me to court for child support. well this weekend i spent the day with my son and when i called here to meet up with her she sounded drunk. so i contacted my local police depart and when i arrived with my son she was drunk so i took my son. because thats what the police told me to do . so now that i have my son can she say i kidnapped him???? and can i get arrested for not returning him??? i dont want to hold him from her but i was just very uncomfortable with the position she put me in.
