I;m seperated 21 year maraige I want to start a new company do I need to be divorced first so my wife cant touch my new company?

There are automatic restraining orders that go into effect when you have issued or are served with a divorce summons. One of the key ones is that you cannot sell, give away, or otherwise transfer any community property or any property that is or is likely to be claimed as community property until the divorce judgment or an interim court order. I'm not sure what kind of company you want to start, but I don't know of many that can be started without any investment at all. So not only could you be setting yourself up for your wife to claim part of the business, you would be in contempt of court if you invest in starting a new business without a court order permitting the investment.
