Legal Question in Family Law in California

Seperation and Taxes

I am seperated from my husband and he does not live in the same house as me. We are not legally seperated I had started to get a divorce, but we put it on hold. Tax season is coming and I was just wondering if I have to file taxes with him. He has not lived in the home for about 9 months, and he has not worked. But since there are no papers stating that we are seperated, does that mean he is intitled to what I may get back from my taxes? Thank you.
