Legal Question in Family Law in California

Setting asidefault / Requesting DNA /Dec. of Paternity signed

I have a case with DA, I have a signhed Dec. of Paternity witness by a hosp offical, child is now 3 1/2, DA has done wage assigment, and now the father is trying to stall the system he denies he is the dad now after being involved from day 1. until he was served for support.

Does the commissioner have the right to over rule the D.O.P. that states on the back when you sigh it you waive all right to contest, and if so you must do so within 2 years. DA says they agree we should set aside until DNA, I say dna is fine, I can not afford for my child supportto be stopped, it has been 1 year and they finally sent me one check. ANY IDEAS???
